Starting on May 5, Utah’s Legislature’s House Bill 308, similar to the legislation in Arkansas and Montana, will prohibit “a government entity from directly or indirectly requiring an individual to receive a COVID-19 vaccine authorized for emergency use as a condition of employment or attendance at events that are hosted or sponsored by a government entity,” according to the NCSL. Utah House Bill 308 prohibits governmental entities from requiring an individual to receive a COVID-19 vaccine. A governmental entity includes: (i) an executive agency, (ii) the legislative branch, (iii) the judicial branch, (iv) the State Board of Education, (v) the Utah Board of Higher Education, (vi) institutions of higher education and (vii) political subdivisions of the state (including school districts). Such entities may not make receipt of the vaccine a condition of employment, participation in activities or attendance at events that are hosted or sponsored by the entity. This prohibition does not apply to an employee who works in a public health or medical setting and are required to receive vaccinations in order to perform their assigned duties and responsibilities. The Bill was signed into law on March 16, 2021.
