Now Republicans Control the Courts, Too

News reports about three recent court decisions — Texas gerrymandering, labor violations by Ralphs supermarket chain and President George W. Bush’s treatment of prisoners at Guantánamo — make it appear that justice prevailed and the wrong-doers got their comeuppance. But the opposite is true.

Instead, these rulings reveal why the Republican Congress, the Bush administration and big business are so effective at getting what they want. They have an “obey when convenient” approach to our laws and judicial system. They break them when it suits their purposes, hoping that either they won’t get caught or, if they do, that the punishment will be a slap on the wrist. In other words, they don’t ask for permission. They ask for forgiveness.

On June 28, the U.S. Supreme Court ruled that the Texas legislature had illegally gerrymandered a Texas congressional district by removing 100,000 Latinos from it to guarantee a safe Republican seat. The court told the Texas legislature to go back and redo the district. Republican Congressman Tom DeLay, the former House Majority Leader, set the stage for this redistricting by illegally raising corporate money which he funneled into the campaigns of Republican candidates for the state legislature in 2002. Thanks in large measure to these illegal campaign contributions, the GOP captured control of the Texas legislature and in 2003 redrew the map of the state’s congressional districts. As a result, in the 2004 elections, the Republicans gained six Texas congressional seats that had previously been held by Democrats. Under the old map, Texas Republicans held only 15 of the state’s 32 seats in Congress. After DeLay redrew the map, Republicans held 21 seats. This helped solidify the GOP’s majority in Congress.

Mass protests in Mexico on 7/16


JOHN ROSS, THE NATION – A full week after the most viciously contested
presidential election in its modern history, a Florida-sized fraud
looms over the Mexican landscape and the nation has been divided
almost exactly in half along political, economic, geographical and
racial lines. . . The disputed election pits an indignant Indian and
mestizo underclass that believes AMLO was swindled out of the
presidency by electoral fraud against a wealthy white conservative
minority that controls the nation’s media, its banks, and apparently,
the Federal Electoral Institute, Mexico’s maximum electoral authorities. . .

At a raucous July 8th rally that put a half million supporters in
Mexico City’s vast Zocalo plaza, the political heart of the nation,
Lopez Obrador called upon his people to demand a complete vote by vote
recount of the results. . . The left leader is calling upon supporters
in all 300 electoral districts across Mexico to initiate a national
“exodus” for democracy that will converge upon the capital on Sunday,
July 16th for a mega-march that may well turn out to be the largest
political demonstration in the nation’s history. . .

Evidence of wide-spread ballot box manipulation in a third of the
130,000 polling places (including ballot-stuffing and duplicate
numbers in thousands of them), malfeasance in the reporting of
district totals to the IFE, inexplicable cybernetic confabulations in
both the preliminary count or PREP (`3,000,000 mostly AMLO votes were
removed) and the final tabulation in the districts, are being
presented to the nation’s top electoral tribunal (code-named the
TRIFE) by Lopez Obrador’s battery of attorneys in an effort to
persuade the seven justices that a hand recount is the only way to
determine who will be the next president of Mexico. Such recounts
have recently been conducted in close elections in Germany, Italy, and
Costa Rica as well as in Florida 2000 until ordered shut down by the
U.S. Suprime Court. . .

Palast on the Mexican election

Florida Con Salsa: Investigative Reporter Greg Palast Reports on Voter Fraud in Mexico’s Presidential Election

In Mexico, populist candidate Andres Manuel López Obrador released a preliminary video yesterday of what he says proves he was cheated out of last week’s presidential election. In a video shot in the central state of Guanajuato, the footage shows an apparent supporter of Calderon’s National Action Party stuffing a ballot box on the day of the elections. Investigative reporter Greg Palast travels to Mexico City to report on the disputed election. [includes rush transcript]

We turn now to the Mexican presidential elections. Last week, election authorities announced that conservative candidate Felipe Calderón, a former energy minister, had defeated Andres Manuel López Obrador by a razor slim margin. This was after electoral officials recounted ballot tallies from the initial vote. The recount showed that Calderon won the presidency by the closest margin in Mexico’s history – around two-hundred-twenty-thousand votes of forty-one million cast – or just over half a percentage point.

But Lopez Obrador has refused to concede citing electoral fraud. On Sunday, Lopez Obrador and his supporters filed a request for a full vote-by-vote recount of the election. They have also called for supporters to begin marching on the capital today and to join up for a huge march in Mexico City on Sunday.

New Report Uncovers Stealth Strategy by US Chamber of Commerce to Influence Elections: Examines Documents in Washington State Attorney General Race

NEW YORK, July 12 /U.S. Newswire/ — A major new report released today by the Center for Justice & Democracy finds that U.S. Chamber of Commerce provides substantial financial and strategic assistance to local front groups to influence state elections, including funding major media buys to smear local candidates.

The report, “The Secret Chamber – The Inner Workings of the U.S. Chamber of Commerce and the Hijacking of an Election,” draws from the cache of newly-released papers and deposition testimony uncovered in connection with litigation surrounding the failed 2004 election bid of Deborah Senn for Washington State Attorney General. Senn, a former pro-consumer insurance commissioner, was viciously attacked in an advertising blitz, which contributed to her defeat. It was only later revealed that the ad campaign was funded by the U.S. Chamber of Commerce and its Institute for Legal Reform. Litigation arose after the Washington State Public Disclosure Commission concluded that the ads violated state election law and the participation of the Chamber and the ILR was revealed.

According to author Laurie Beacham, “This report shows that the U.S. Chamber of Commerce is involved in an organized, aggressive, covert and nasty effort to infiltrate local election campaigns. While the Chamber tries to disassociate itself from the negative campaigning conducted by its local front groups, it remains actively involved in elections, pursuing all the trimmings of a full-out political campaign.”

Not one cent to the Democrats, until….

MCM had a recent message with a link to Brad Blog and the interview with Ring of Fire about the recent San Diego special election. In the interview, the question is asked: Why did Francine Busby concede so quickly when the vote had not been certified? Answer: Because she, like all Democratic candidates, had been told by the DCCC not to touch the voting integrity issue.

This, of course, made me furious. Exactly what stimulus would be required for the official arms of the Democratic Party to find the COURAGE to stand up, speak out, and confront the organized effort to suppress the Democratic vote? We learned after the
2004 election that the largest RNC expenditure was to Sproul and Associates, which is alleged to specialize in vote suppression tactics. We are about to go into
our FOURTH national election in which Democrats have no announced strategy to protect the votes of their constituents.

I went immediately to to tell them again that I will contribute no money until such time as Democrats have a strategy to address the organized effort to suppress our votes.

Republican Congressman Says Bush Should Be Removed from Office

A radio show reported yesterday that Republican Texas Congressman Ron Paul said the following:

“I would have trouble arguing that he’s been a Constitutional President, and once you violate the Constitution and be proven to do that I think these people should be removed from office.”

And this: “Congress has generously ignored the Constitution while the President flaunts it, the courts have ignored it and they get in the business of legislating so there’s no respect for the rule of law.”

And this: “When the President signs all these bills and then adds statements after saying I have no intention of following it – he’s in a way signing it and vetoing – so in his mind he’s vetoing a lot of bills, in our mind under the rule of law he hasn’t vetoed a thing.”

Great overview of the Big Theft

The stolen election of 2004

The 2004 presidential contest between Democratic challenger Senator John Kerry and the Republican incumbent, President Bush Jr., amounted to another stolen election. This has been well documented by such investigators as Rep. John Conyers, Mark Crispin Miller, Bob Fitrakis, Harvey Wasserman, Bev Harris, and others. Here is an overview of what they have reported, along with observations of my own.

Some 105 million citizens voted in 2000, but in 2004 the turnout climbed to at least 122 million. Pre-election surveys indicated that among the record 16.8 million new voters Kerry was a heavy favorite, a fact that went largely unreported by the press. In addition, there were about two million progressives who had voted for Ralph Nader in 2000 who switched to Kerry in 2004.

Yet the official 2004 tallies showed Bush with 62 million votes, about 11.6 million more than he got in 2000. Meanwhile Kerry showed only eight million more votes than Gore received in 2000. To have achieved his remarkable 2004 tally, Bush would needed to have kept all his 50.4 million from 2000, plus a majority of the new voters, plus a large share of the very liberal Nader defectors.
