Kennedy supports the filibuster!

From Sheila:

Dear all,

I have just received this from Senator Kennedy’s Boston office. Now we need one like this from 40 more. Keep on keeping on. Sxoxo

Other than voting to send our men and women to war, there is no more important vote in the Senate than our vote on a Supreme Court nominee. This is a vote of a generation and a test of conscience. Judge Alito does not share the values of equality and justice that make this country strong. He does not deserve a place on the highest court of the land.

We owe it to future generations of Americans to oppose this nomination. If Judge Alito is confirmed, he will serve on the court long after President Bush leaves office, and the progress of half a century on the basic rights of all Americans is likely to be rolled back. Heís the wrong Justice for justice and the rule of law in America.

AOL won't let me email you

Those of you who are on my list-serve, and who are AOL subscribers, may not have been hearing from me lately, as my messages to all such addressees bounce back to me. The corporation seems to have decided that my messages are spam.

I could try to fight this, or you could stop being AOL subscribers. I don’t know which one of those would be the bigger hassle, but I do know that, right now, I don’t have time to deal with it, what with the daily press of business and the rise of the police state here inthese United States.

In any case, the messages sent to the list all end up posted here.

Schumer DOESN'T GET IT!!!

Senator Charles Schumer is arguing against a filibuster.
A filibuster is the only chance we have to defeat Alito – and the wrong message to be sending George Bush and the Republicans
Call Schumer immediately and express your outrage!!!

Mary Landrieu DOESN'T GET IT!

I’m asking Texans, especially, but really anyone, to FOCUS ON MARY LANDRIEU to defeat Alito.

Senator Mary Landrieu (D-LA) is speaking publicly against a filibuster of the Alito nomination for Supreme Court.

She says there is more important business the Senate needs to get on with. !!!!!

Ted Kennedy said yesterday during Alito Senate debate: “The stakes could not be higher. This is the vote of a generation.”

Rainbow Push writes re Alito: “50 years of civil, human and women’s rights advances are at stake – from Brown v. Board of Education, the Civil Rights Act of 1964, and the Voting Rights Act of 1965. “

If confirmed, Alito at age 55 could serve out his life expectancy on the court — 28 years — in other words, the next SEVEN CONSECUTIVE PRESIDENTIAL TERMS.

Vote is in the next few days.

Landrieu is one of eight Democratic Senators needed to stop Alito.

You can just say YOU MUST FILIBUSTER. Or, if you want to try to be persuasive, ask to speak to Kevin Avery at (202) 224-5824. He is her DC staff person who is in charge of judiciary issues.

Help Hillary make up her mind!

New York’s junior senator has not released a statement on the filibuster yet. Although she plans to vote against Alito, she does not yet support a filibuster.
Please help her make the right decision, and as soon as possible.
Email her, or call one of her offices, RIGHT NOW. (Contact info below.)
If Kerry can support the use of this bold tactic, why can’t she?

Numbers for key senators: CALL NOW!

Dear Enraged and Engaged Activists,

Thank you for all the tremendous work you’ve done at home, at school, and many of you in Washington, D.C., to defeat the Alito nomination. The judiciary committee vote, with all eight democrats voting NO, was an encouraging first step.

Despite rumors in the media, all hope is not lost. The Senate Democrats can FILIBUSTER. We’re asking for one last push from our dedicated activists. Please call the Senators listed below to implore them to filibuster to save the Court from the radical right wing agenda. The support of these Senators is crucial in mounting a filibuster. And a no vote without a filibuster is a meaningless gesture. Our Senators’ commitment to women’s rights is a hollow shell if they will not fight to preserve them.

It only takes a few moments to call the offices of the Senators listed below, and your call could truly tip the balance and save the court.

Sen. Blanche Lincoln 202-224-4843
Sen. Mark Pryor 202-224-2353

Sen. Joseph Lieberman 202-224-4041

Sen. Mary Landrieu 202-224-5824

North Dakota:
Sen. Byron Dorgan 202-224-2551
Sen. Kent Conrad 202-224-2043

South Dakota:
Sen. Tim Johnson 202-224-5842

West Virginia:
Se. Robert Byrd 202-224-3954

Just off the phone with Ryan in Senator Kerry’s office in DC: Kerry is now publicly
in support of a filibuster, and is now working with colleagues in the Senate to drum
up the necessary support (41 votes).

We must call him and say YES, and he must go for it ON THE FLOOR–even if he thinks he does not have every vote.

CALL NOW: 202-224-2742

Four strikes against Alito

I. Repression

From a friend:

This Washington Post article just goes to show any reasonable person that by using a police state to create a climate of fear, Bush effectively silences dissent in the short term to promote his reactionary Christo-Fascist agenda. Are you willing to get arrested, ruin your career, be humiliated? Remember this: 19 of the 56 signers of our Declaration of Independence lost everything so we could oppose any future tyrant. Now is the time to fight the confirmation of Alito – If he’s on the court, free citizens may lose our day in court to peacefully oppose the lunatic living in the White House.

Suit Turns D.C. Arrests Into Free Speech Victory

By Paul Schwartzman
Washington Post Staff Writer
Wednesday, January 26, 2005; B01

Joe Mayer attended the demonstration downtown that morning in 2002 to protest what was then a brewing conflict in Iraq. He also went to ensure that his daughter Alexis did not get arrested and potentially harm her fledgling career as a lawyer.

What transpired was what the retired Army colonel most feared: He and his daughter were among a mass of protesters arrested, handcuffed and detained for as long as 36 hours, an ordeal that included hours confined on a bus and many more hours on floor mats at the Police Academy before they were released.

“It was frightening, the police charging at you in their riot gear for no apparent reason,” said Mayer, 71, recalling yesterday the clash at Pershing Park. “I’m thinking, ‘What’s going on?’ “

II. Surveillance

White House Dismissed ’02 Surveillance Proposal

By Dan Eggen
Washington Post Staff Writer
Thursday, January 26, 2006; A04

The Bush administration rejected a 2002 Senate proposal that would have made it easier for FBI agents to obtain surveillance warrants in terrorism cases, concluding that the system was working well and that it would likely be unconstitutional to lower the legal standard.

The proposed legislation by Sen. Mike DeWine (R-Ohio) would have allowed the FBI to obtain surveillance warrants for non-U.S. citizens if they had a “reasonable suspicion” they were connected to terrorism — a lower standard than the “probable cause” requirement in the statute that governs the warrants.

The administration has contended that it launched a secret program of warrantless domestic eavesdropping by the National Security Agency in part because of the time it takes to obtain such secret warrants from federal judges under the Foreign Intelligence Surveillance Act (FISA).

III. Two editorials: Buzzflash and the Times agree!

This Isn’t A “Vote Of Conscience” Concerning A Filibuster; It’s A Vote To Save Democracy. And If Reid Can’t Cajole And Bluster 41 Democrats Into Saving Democracy, He Should Resign His Position.

Read this vital BuzzFlash Editorial at:

Senators in Need of a Spine

Judge Samuel Alito Jr., whose entire history suggests that he holds extreme views about the expansive powers of the presidency and the limited role of Congress, will almost certainly be a Supreme Court justice soon. His elevation will come courtesy of a president whose grandiose vision of his own powers threatens to undermine the nation’s basic philosophy of government – and a Senate that seems eager to cooperate by rolling over and playing dead.

Harry Reid met with progressive lobbyists on Tuesday and told them he has nearly 44 votes against Alito, but there are 8 Democratic Senators who will not support a filibuster.

Only 41 votes are needed for a filibuster. If Reid has nearly 44 votes against Alito, every one of those Senators should support a filibuster or their vote against Alito is meaningless.

So call the Democrats who are leading this battle and demand a united Democratic filibuster:
Harry Reid (NV)
Dick Durbin (IL)
Chuch Schumer (NY)
Debbie Stabenow (MI)
Pat Leahy (VT)

Use these toll free numbers to call the Capitol: 888-355-3588 or 888-818-6641. If you can’t get through, look up the Senator’s District Office number in your phone book or here:

Reid would not name the “Alito 8” who are blocking a Democratic filibuster – so we need to identify them and tell them not to betray the Democrats who funded them and voted for them.

The most likely suspects are the “Red State” Democrats:
Tom Carper (DE)
Kent Conrad (ND)
Byron Dorgan (ND)
Tim Johnson (SD)
Mary Landrieu (LA)
Blanche Lincoln (AR)
Mark Pryor (AR)

Also call these “Blue State” and pro-choice Republicans:
Lincoln Chafee (RI)
Susan Collins (ME)
Lisa Murkowsky (AK)
Bob Smith (OR)
Olympia Snowe (ME)
Ted Stevens (AK)

For extra credit, call all the 2008 Presidential candidates who are sitting Senators – Evan Bayh, Joe Biden, Hillary Clinton, Russ Feingold, and John Kerry – and tell them to either LEAD THE FILIBUSTER or FORGET ABOUT YOUR SUPPORT.

You can also send that message to the Democratic Senatorial Campaign Committee (202-224-2447) and the Democratic National Committee (202-863-8000).
