This article from today’s NY Times made me nervous for two reasons:

1) Doesn’t it look like this is a set up? Another 1.8 million dollar study for what purpose??: The study was set up to avoid the controversy surrounding a similar analysis in California……Industry leaders said the California tests did not take into account the effectiveness of security measures like surveillance cameras and log-in sheets that limit access to machines and could prevent some hacking.

“There are some promising signs, but the jury is still very much out in Ohio, where they are involving in the review elections officials, folks with extensive election experience,” said Chris Riggall, a spokesman for Premier Election Solutions, of Allen, Tex.

and 2) the Times and everyone else is just going to stop calling them Diebold as if they’re not the same people– what about that isn’t exactly like 1984

Ohio to Test Vote Systems Before March

CINCINNATI, Sept. 26 – Ohio is trying to identify and correct serious problems with the security and reliability of voting machines in time for the presidential primary in March.
As part of the effort, all five systems used in the state, as well as next-generation systems being considered, will be tested, Secretary of State Jennifer Brunner said Wednesday.

Ms. Brunner said she ordered the study to help restore the confidence of voters, a majority of whom voiced doubts about the reliability of the voting machines in a survey last year.

I represented Clint Curtis, John Russell, and Frank Gonzalez in
contesting their alleged losses in 2006 in Florida State court and in
the U.S. House of Representatives. Our contest was instrumental in
exerting the pressure to pass a paper ballots law in Florida which at
least gives us something to count if someone can find an attorney who
will file a lawsuit or a contest. However, these contests were
dismissed WITHOUT any review of the evidence and contrary to the law
as well as the rights of the candidates and voters to have the votes
counted.

If you are wondering why you didn’t hear about this, it could be due
to the media cartel’s refusal to cover election fraud and judicial
corruption. If you want judicial reform, you need to realize that
without assurance that the votes are counted, you will not be able to
elect leaders who will respond to your demand that judges should
follow the law or be removed from power. Finally, if you want media
reform, you need fair elections to elect leaders who will help break
up the media cartel, but you can also help by turning to independent
media sources like OpEdNews.com and Genesis Communications Network
and spreading the truth about what is really going on.

Do you want to restore and preserve our democracy, or do you want to
entrust it to those who would continue to use secret vote counting
machines which are unreliable, expensive, and unnecessary? If you
are for the Holt bill, think about your position and how easy it
would be to restore and preserve our democracy with a bill mandating
paper ballots and public vote counts. If you are for fair elections,
spread the word like Paul Revere before Holt passes and the powers
that be claim that they have “fixed” our elections. (Imagine Bush,
Cheney, et al., smiling like the Grinch and laughing sinisterly every
time they hear this repeated.)

We are finally going to trial starting on Wednesday, September 26, 2007.

My name is Jeffrey Sauger. I’m a CMU alumni, OU alumni, MPPA member, NPPA member and freelance photographer in the Detroit area. I was one of three photographers arrested while covering a nazi rally in Toledo back in Dec. ’05 for “criminal trespass” while standing in the “media” area on a public street. Jim West, another Detroit freelancer and ASMP member, was also arrested that day for “failure to disperse.” Suffice to say, we refused to sign a waiver admitting guilt and absolving the city of Toledo of any wrongdoing and are finally going to trial next week.

Though this is a misdemeanor punishable by a fine up to $250 and up to 30 days in jail, the city of Toledo will not drop the charges without a signed waiver.

This is about more than the inconveniences Jim West and I have had. This is about the fact that we are professional photojournalists whose constitutionally guaranteed rights have been trampled on by agencies that exist “to protect and to serve” the public citizen on the backs of the public citizen’s tax dollars. This is about eroding civil rights in a post-9/11 America. This is about not taking the easy way out because this type of case affects the ability of all journalists’ ability to do their job.

If we could ask you to post something to your member site, pass this press release on to photojournalism students, colleagues and even your newspapers, we’d greatly appreciate any support. We’re hoping to have fellow photojournalists attend the trial in a show of support. The trial will be held before Judge Lynn H. Schaefer. Jury selection will begin Wednesday morning, September 26, in Courtroom 7 of Toledo Municipal Court, 555 North Erie Street in Toledo. The trial is expected to last two to three days.

News Photographers Face Trial in Toledo for Covering Nazi Rally

Two professional news photographers are scheduled to stand trial in Toledo, Ohio, on September 26 following their arrests nearly two years ago while covering a rally by a small group of Nazis outside the Government Center building.

Both were arrested as they photographed the events of December 10, 2005, including not only the Nazis and the noisy but peaceful crowd of anti-Nazi protestors, but also the actions of the police officers. Police from 13 Ohio jurisdictions were mobilized to present, in the words of Toledo officials, a “show of force” with “zero tolerance” for the day. With nearly 1,000 members of law enforcement present, many on horseback, the police outnumbered both the Nazis and the protestors by approximately five-to-one. “The arrests were an attack on freedom of the press,” said the photographers’ attorney, Julie Hurwitz. “We believe the evidence will show that these professional journalists were arrested not because they violated the law, but because they were photographing an overly aggressive police response to citizens exercising their fundamental constitutional rights to protest. As a result of being arrested, they were prevented from doing their jobs of being the ‘eyes of the world,’ and fulfilling their roles as an integral part of our communication system by which the public obtains the necessary information to be informed participants in a democracy.” Hurwitz said, “my clients are guilty of nothing other than what New York Times editor Bill Keller said of the Times research assistant Zhao Yan, recently released from a Chinese jail, namely the ‘offense of practicing journalism’”]

The photographers, Jeffrey Sauger of Royal Oak, Michigan, and Jim West of Detroit, are both professional freelancers with many years’ experience working for a wide variety of national newspapers, magazines, and photo agencies. At the Nazi rally, Sauger was working for the European Pressphoto Agency, which distributes photos to newspapers around the world. West was working for the Southern Poverty Law Center, a nonprofit organization which, among other things, tracks hate groups across the country and publishes the highly respected magazine Intelligence Report, to which more than 60,000 law enforcement officers nationwide subscribe.

Sauger was arrested on a charge of “criminal trespass” as he stood in a media en
closure carrying professional cameras and lenses photographing the scene. Po
lice charged that he lacked a “temporary media permit” that had been issued to some journalists earlier in the day. Arriving later, carrying his own press credentials, Sauger said officers had told him he didn’t need the pass.

West was arrested as he stood, alone, taking photographs near a line of horses that was being ridden past and through counter-protesters. He was charged with “failure to disperse.”

Charges of disorderly conduct against a third news photographer, Jeffrey Willis of the Toledo Journal, have been dismissed. Willis was also arrested while photographing the police response to a crowd of anti-Nazi protesters.

“This case is important because the news media was targeted for reporting on questionable governmental activities,” said Hurwitz. “One thing that distinguishes a democratic country is the fundamental right to freedom of the press. When that goes, our basic liberties are at stake.”

The trial will be held before Judge Lynn H. Schaefer. Jury selection will begin Wednesday morning, September 26, in Courtroom 7 of Toledo Municipal Court, 555 North Erie Street in Toledo. The trial is expected to last two to three days.

FCC Fines Comcast for Fake News
Groups call on agency to take action against hundreds of other stations airing video news releases without disclosure
WASHINGTON — Today, in response to a complaint filed in 2006 by Free Press and the Center for Media and Democracy, the Federal Communications Commission announced its intention to fine Comcast for airing a video news release (VNR) for “Nelson’s Rescue Sleep” on its CN8 news channel without identifying the sponsor.
“We’re pleased to see the FCC is finally waking up to the issue of fake news,” said Craig Aaron, communications director of Free Press. “But the fine levied against Comcast is just the tip of the tip of the iceberg. Video news releases dressed up as real news were uncovered at more than 100 stations. We hope the FCC will soon fine those stations and issue clear guidelines to end the epidemic of fake news once and for all.”
Comcast’s CN8 news channel — which airs in 20 TV markets, including New York, Philadelphia and Washington, D.C. — was caught by the Center for Media and Democracy airing at least four more VNRs without disclosure. However, today’s announcement by the FCC contains no mention of those instances — or the two broadcast stations caught airing the exact same VNR without disclosure.
“The Commission’s action against CN8 is precedent setting. It rejects the PR industry’s argument that no disclosure is needed if the television station has not received direct payment to air a VNR,” said Diane Farsetta of the Center for Media and Democracy, who conducted the group’s extensive investigation on fake news. “The Nelson’s Rescue Sleep VNR was remarkable for its shameless product promotion. But the FCC must require disclosure in all cases when a VNR is used, whether it’s for a new product or a government policy. Viewers have a right to know who’s trying to persuade them.”

Pasadena church wants apology from IRS
All Saints’ rector also demands that the agency clarify its findings after closing its probe into an antiwar sermon in 2004.

The Internal Revenue Service has told a prominent Pasadena church that it has ended its lengthy investigation into a 2004 antiwar sermon, church leaders said Sunday.

But the agency wrote in its letter to All Saints Episcopal Church that officials still considered the sermon to have been illegal, prompting the church to seek clarification, a corrected record and an apology from the IRS, the church’s rector told standing-room-only crowds of parishioners at Sunday’s services.

The church also has asked the Treasury Department, which oversees the IRS, to investigate allegations that officials from the Justice Department had become involved in the matter, raising concerns that the investigation was politically motivated.

My friend John Bowe will be appearing on the Jon Stewart show tonight to talk about his new book, “Nobodies: Modern American Slave Labor and the Dark Side of the New Global Economy.” The book’s focus is on the plight of Mexican and Central American farm workers in Florida, East Indian labor abuse in Tulsa and Asian “guest worker” abuse in Saipan, an American territory in the Pacific Ocean. John is an award-winning (and excellent) writer. The book demonstrates how “globalization” and the labor abuses (i.e., slavery) that result have had the effect of degrading not only foreign workers who are abused in the U.S. but also the character of our society as a whole. It’s important for anyone who cares about the cause of human dignity.

WASHINGTON – In sharp contrast to the lionization of General David Petraeus by members of the US Congress during his testimony this week, Petraeus’s superior, Admiral William Fallon, chief of the Central Command (CENTCOM), derided Petraeus as a sycophant during their first meeting in Baghdad in March, according to Pentagon sources familiar with reports of the meeting.

Fallon told Petraeus that he considered him to be “an ass-kissing little chickenshit” and added, “I hate people like that,” the sources say. That remark reportedly came after Petraeus began the meeting by making remarks that Fallon interpreted as trying to ingratiate himself with a superior. That extraordinarily contentious start of Fallon’s mission to Baghdad led to more meetings marked by acute tension between the two commanders. Fallon went on to develop his own alternative to Petraeus’s recommendation for continued high levels of US troops in Iraq during the summer.

Today, his article appeared in the Chronicle, “S.F. supervisors blamed for blocking new voting system.” He did not publish anything I said. He mostly presented the point of view of Mayor Newsom. The monied interests are winning today.

Newsom says the board made a mistake in rejecting the Sequoia $12.6 million contract. We don’t think so.

* Newsom implies that buying Sequoia would mean SF would “get it right.” The Secretary of State’s top-to-bottom review uncovered a litany of problems with the Sequoia system. Is this what the Mayor means by getting it right?

* A new voting system based on open source software would be much better, fully transparent, and far less expensive. The could open the bid for such a system at any time. Even though no such system is currently certified, that work could be included in the bid. Here’s an example of a system that uses FREE software based on an international standard.

But if they don’t like that one, it doesn’t matter. Any vendor could provide a system to meet the bid requirements. We recommed that the bid specify OPEN SOURCE so everything is open to public scrutiny.

* When the Mayor advocates for Sequoia, he is advocating for private ownership of information that should all be public. This is wrong.

John Wildermuth’s “S.F. supervisors blamed for blocking new voting system” ignores the key issue, that we need to be confident that every vote has been counted accurately.

We have grown accustomed to instant election returns, but are also finding that electronic voting machines can be hacked and elections stolen.

San Francisco is doing absolutely the right thing to not spend $12M on new Sequoia voting machines. They will soon be obsolete, because they cannot be trusted as long as secret,
proprietary source code is embedded in every machine. By blocking the new Sequoia voting system, San Francisco now leads the nation in demanding public disclosure of the source
code in voting machines. Open source code must come next.

Let’s not forget Ohio and Florida when we think about honest elections. Secretary of State Debra Bowen’s review of all voting machines in the State shows that safequards are
needed. We all want our votes to be counted, and that’s exactly what Bowen is trying to ensure.

To help speed the vote count San Franciscans should vote by absentee ballot to the maximum extent possible, so that their ballots will be counted as the polls are closing on Election Day.
