Plaintiffs Applaud California Secretary of State’s Recent Action on Voting Systems

Case Challenging The Use of Diebold Electronic Voting Machines Is Withdrawn

SACRAMENTO, CA – A group of California voters who filed suit challenging former Secretary of State Bruce McPherson’s 2006 certification of Diebold electronic voting machines for use in California announced today that they were withdrawing their court case following Secretary of State Debra Bowen’s recent decision to decertify the Diebold system and to only allow limited use of that system under strict manual recount conditions. The voter plaintiffs said that Secretary Bowen’s action constituted a vindication of the concerns raised in their lawsuit concerning vulnerabilities and inadequacies of the Diebold machines, and that Secretary Bowen’s actions answered nearly all of the concerns outlined in their original complaint filed last year.

“We thank Secretary Bowen for her leadership and her courage,” said Dolores Huerta, one of the voter plaintiffs in the case. “Her decision is a victory for democracy in California. It marks a major step forward in protecting the integrity of our electoral process.”

In March 2006, a group of 24 California voters, including Huerta, social justice activist and co- founder of the United Farm Workers of America, filed a lawsuit in state court against then-Secretary of State Bruce McPherson and various county registrars to halt the use or purchase of the Diebold TSx electronic voting system. The lawsuit alleged that the Diebold TSx voting machines did not meet requirements of California law with regard to security from tampering and vote manipulation, accessibility to voters with certain disabilities, and auditability, and that the machines were unsuitable and unsafe for use in California elections.

On August 3, 2007, Secretary Bowen withdrew the certification of the Diebold and other electronic voting systems for use in California, except under limited circumstances. Her decision followed a comprehensive review of voting systems in the state showing that the Diebold machines, among others, were plagued by serious security problems that threatened the integrity of the vote in California.

Secretary Bowen permitted conditional reapproval of the machines for use only if strict conditions are met. Under her new order, California counties will be able to use only one machine per precinct to meet federal requirements for accessible balloting for voters with disabilities, and the counties will be able to use such machines for early voting. Secretary Bowen further required that counties using this technology under such conditions conduct a 100% manual recount of the paper records produced by the machines.

“Secretary Bowen should be commended for moving the state of California and the nation in the right direction on this critical question facing the security of our elections today,” said Charles Fox, another voter plaintiff in the case. “While the machines currently employed for the stated purpose of greater accessibility fall far short of providing the required accessibility under federal law for voters with disabilities, we look forward to working with the Secretary of State’s office in the ongoing effort to ensure meaningful access for all of California’s voters.”

Attorneys John Eichhorst, Michael Gallo, Jason Takenouchi, and D’Lonra Ellis from the law firm of Howard Rice Nemerovski Canady Falk & Rabkin in San Francisco served as counsel for the plaintiffs in the case. The lawsuit was filed with the support of Voter Action, a non-profit legal advocacy organization dedicated to protecting the integrity of US elections. Voter Action’s co-founder, Lowell Finley, served as co-counsel for the plaintiffs until January 2007, when he assumed the position of Deputy Secretary of State for Voting Systems Technology and Policy in the California Secretary of State’s Office.

“We are proud of the role this case played in helping to catalyze Secretary Bowen’s historic decision on voting systems in California,” said John Eichhorst, the lead attorney for the plaintiffs. “Secretary Bowen’s review confirmed the security vulnerabilities we had identified and discovered additional problems with the systems. Her action unwound the certification at issue in our case and sent a strong signal about the importance of election integrity in California.”

“The voters who stood up to bring this case last year are citizen heros and heroines,” said Holly Jacobson, Voter Action’s director and co-founder. “We are honored to have supported them in this case and we will remain vigilant in fighting to protect the right to vote in California and across the country.”

Psychologists and the Torture Question

A few weeks ago, I reported that two major professional organizations-the lawyers (ABA) and the psychologists (APA)-appeared poised to condemn the Bush Administration’s torture policies and to stake out principled positions against their members’ collaboration in these practices. Well they did, sort-of.

The 400,000-member American Bar Association passed a resolution which was unequivocal and very strong in its terms. They condemned President Bush’s July 20, 2007 Executive Order, calling it illegal, and they called on Congress to overturn it through legislation. They even committed their resources to lobbying for Congressional action on the issue. The vote in the House of Delegates was 545 to 1. Rather lopsided.

However, the American Psychological Association took a far more nuanced position. They condemned some of the techniques that Bush authorized as “torture.” That was a step forward. But they turned down a resolution counseling members to refrain from involvement in highly coercive interrogation process, largely on the strength of members associated with the Department of Defense who argued that the presence of psychologists was essential to prohibit abuse. Indeed, Agence France Press captioned its report this way: “US psychologists limit roles in torture of military prisoners”. I think this is far from commentary. AFP got the story just right.

WWWT Talk Radio to Replace Post’s Programming

Bonneville International Corp. will launch radio station WWWT to replace WTWP, its radio-station venture with The Washington Post that will end next month.

The new station will feature local and syndicated talk shows to replace programming provided by The Post. WWWT, dubbed “Talk Radio 3WT,” will begin airing Sept. 20. WWWT will be simulcast on the same frequencies on which Washington Post Radio now airs: 1500 AM, 107.7 FM and 820 AM.

Bonneville has lined up four nationally syndicated programs for the station: three featuring conservative-libertarian personalities — Neal Boortz, Glenn Beck and Bill O’Reilly — and one with liberal Stephanie Miller. Reflecting its ideological diversity, the station’s slogan will be, “Left, Right, and Whatever We Want.”

Report:
US Has Prepared to Attack Iran

Detailed Pentagon plans for a military attack on Iran are far more extensive than has been reported in the U.S., according to top British military analysts. There have been occasional news reports on various strategic bombing options – both conventional and nuclear – but this is the first comprehensive look at the full range of Pentagon plans.

A new report obtained by RawStory.com concludes that the United States has made major preparations to attack Iran, and that such an attack will likely target much more than just weapons or nuclear facilities.

To: Civil Rights Division of the U.S. Department of Justice

We respectfully request that the Civil Rights Division of the United States Department of Justice review events surrounding the prosecution of six Black students in Jena, Louisiana, to determine whether the civil rights of Jena residents have been violated.

In a May 20, 2007 Chicago Tribune article titled “Racial Demons Rear Heads,” Howard Witt reported that the six students faced prosecution for charges including second degree attempted murder — and possible prison sentences of up to 100 years — for allegedly participating in an unarmed school brawl that resulted in no serious injuries. The alleged brawl followed months of racial tension after hangman’s nooses were hung from a tree at the students’ school.

From the same Chicago Tribune article:

“There’s been obvious racial discrimination in this case,” said Joe Cook, executive director of the Louisiana chapter of the American Civil Liberties Union, who described Jena as a “racial powder keg” primed to ignite. “It appears the black students were singled out and targeted in this case for some unusually harsh treatment.”

The prosecution of these young men represents a gross miscarriage of justice, punishing Black students for opposing segregation of their schools while ignoring the threatening and provocative acts of those engaging in segregation.

We respectfully request that the Civil Rights Division of the United States Department of Justice launch a full investigation into events in Jena, Louisiana, beginning with the noose incident of August 31, 2006, and culminating in the alleged fight of December 4, 2006 to determine whether the civil rights of Jena residents have been violated.

Craig Arrested, Pleads Guilty
Following Incident in Airport Restroom

Sen. Larry Craig (R-Idaho) was arrested in June at a Minnesota airport by a plainclothes police officer investigating lewd conduct complaints in a men’s public restroom, according to an arrest report obtained by Roll Call Monday afternoon.

Craig’s arrest occurred just after noon on June 11 at Minneapolis-St. Paul International Airport. On Aug. 8, he pleaded guilty to misdemeanor disorderly conduct in the Hennepin County District Court. He paid more than $500 in fines and fees, and a 10-day jail sentence was stayed. He also was given one year of probation with the court that began on Aug. 8.

A spokesman for Craig described the incident as a “he said/he said misunderstanding,” and said the office would release a fuller statement later Monday afternoon.

It is a call to arms of sort to these fundie Xtian ideals…Chuck Baldwin is a John Bircher and he keeps putting out these calls for Xtian activists…men who are the head of their home and families, “having his wife and children in subjection to his authority. No henpecked men here.”
Looks like they plan to be ready in case of a Xtian takeover, a la The Handmaid’s Tale.
Help Me Locate The Black Regiment

Faithful readers of this column know of my burden for the pastors of America. Without informed, energized, and engaged pulpits, I see little hope for the maintenance of liberty and independence in this land.
When the colonies broke free from the shackles of the Crown, it was the moral and spiritual strength of colonial pulpits that helped lead the way. These revolutionary preachers became known as The Black Regiment, due to the long, black robes they were known to wear in the pulpit.
The Black Regiment taught their congregations the principles of freedom Sunday by Sunday. They expounded, explained, and extrapolated the Biblical principles of authority and jurisdiction carefully and meticulously. As a result, the men of colonial America were so well informed, both spiritually and politically, that when the time came to declare their independence, they had both the heart and mind to do it. Statesmen took up the pen, and soldiers took up arms in the greatest fight for freedom in world history. And leading both statesman and soldier was the Black Regiment.
