Larry is from Texas and moved to Utah several years back for business and to
raise his children in a small town without a polluted environment. Larry is
a Gulf War I Vet who came back from the middle-east with Gulf War Veterans
Illness.

He was a professor at a law school in Houston prior to moving. Larry even
resigned his alumnus membership where he taught law because the law school
invited Ken Starr to give the commencement address one recent year.

Larry currently teaches Constitutional Law at George Wythe College in
Utah(http://www.gwc.edu/faculty_ldaniel.asp), a conservative “great books”
institution where he is the voice of reason moving these students to think.

Larry is starting a liberal law school called Bethesda. The name
“Bethesda” is taken from the Hebrew for “house of mercy” designating BCL as
a genuinely unique effort to return principles, ethics, commitment to
service, and professionalism to the system of justice as it currently exists
in the United States, and to counteract the adverse influence of the
conservative movement upon the US legal system and society in general.

Larry believes that by starting law schools and creating think tanks, he
can help reshape the attitudes and beliefs of some of our lawyers before
they go out in the world and begin to practice law. We can also provide
scholarships to provide interns to liberal politicians and institutions
similar to what the conservatives have been doing for 30 years.

A group in South Carolina formed a liberal law school 3 years ago called
Charleston School of Law. Larry’s use of the law school to fund think tanks
is brilliant and the only one like it.

MOVIE REVIEW | ‘AMERICAN BLACKOUT’

Anger and Irregularities at the Voting Booth

Few things in a democracy are more sacrosanct than the right to vote, and in his furious documentary “American Blackout,” Ian Inaba assembles compelling evidence to support his claim that African-Americans – who are traditionally more likely to vote Democratic – are being deliberately and systematically excluded from the political process.

Interviewing Congressional leaders, journalists and regular voters, Mr. Inaba begins by addressing the Florida debacle of 2000, arguing that behind the exhaustive coverage of hanging chads and faulty voting machines lies an underreported and more complex story of black disenfranchisement. In a strong middle section, the movie examines the political troubles of Representative Cynthia McKinney, a vocal critic of the Bush administration, suggesting that her ouster in 2002 was engineered by Republican crossover voting. A particularly powerful segment shows how at least one of Ms. McKinney’s statements about the Sept. 11 attacks was edited by some commentators to appear infinitely less reasonable than the original.

By the time we reach the 2004 general election, the anger in “American Blackout” is palpable. As we listen to voters complain about roadblocks and false felony records, and watch the endless lines of black voters standing patiently in the rain in Ohio, it’s impossible to ignore the gravity of the film’s claims. Though occasionally inflammatory – one interviewee talks about being “slingshotted into slavery” – “American Blackout” isn’t a conspiracy rant. It’s a methodical compilation of questions and irregularities that deserves a wider audience.

The New York Times Book Review Cheap Shot
You know there’s something deeply dishonest about a book review when it ignores the entire premise of the book in question. For a perfect example, see Sunday’s New York Times Book Review critique of Sidney Blumenthal’s “How Bush Rules.”

The book, a collection of Blumenthal’s Salon and Guardian essays, is built around two simple ideas; that Bush’s presidency has been a radical one and a failed one.

Yet the Times review refuses to address either point, choosing instead to dance around the edges, belittling Blumenthal for being too angry and too serious. I kid you not. Blumenthal lays out in excruciating detail the sins of the Bush administration–lives lost, billions squandered, international reputations diminished–and the Times deducts points because the book isn’t funny enough. (What’s funny is the fact the Times didn’t assign the review to a Washington political pro or presidential historian, but a MSM Gotham City magazine writer whose recent articles have included stories like “My Life as a Thin Person” and “Are Jews Smarter?”)

Every author understands that the politics of book reviews can be complicated and infuriating, and for the most part it’s every man and woman for themselves. (Disclosure: Blumenthal is a friend and former colleague of mine.) But what makes this review so irksome is it doubles as a swipe at an entire political movement; a calculated attempt to dismiss and ridicule Bush critics who time and again have been proven right about his incompetence, yet remain MSM targets. Indeed, the Times critique strains mightily to paint Bush critics as “smug,” “unglued,” “condescending,” “berserk”, and “not wholly credible” “loathers” who reside beyond the mainstream.

Pollworkers For Democracy Calls On Voters To “Give A Day For Democracy”

In light of a national pollworker shortage of 500,000 and persistent controversies around polling, citizen action groups have joined forces in a new national “Pollworkers for Democracy” campaign.
VoteTrustUSA, along with our partners Mainstreet Moms, and Working Assets launched last week with a call to “give a day for democracy” by signing up to work the polls. In its first days, 1435 new pollworkers have signed up nationwide.

“It’s time to give a day for democracy and sign up to work the polls.” said Megan Matson (pictured at left), of Mainstreet Moms, “The only way our democracy can truly work is by turning concern into action and becoming part of the solution. Helping voters and assisting elections officials is a simple, supportive and paid way to do this.”

At present pollworkers are hired, trained and paid by their local election officials to work in their county on Election Day – the average age of a pollworker is 72. Pollworkers for Democracy is recruiting pollworkers to help with the kind of problems seen in recent primaries: thousands of frustrated would-be voters, long delays, and confusion generated by failing voting machine systems. These problems, combined with a recent flurry of lawsuits and a growing stack of government and institutional reports against electronic voting machines have lead to low public confidence in the American electoral system. Pollworkers for Democracy aims to encourage citizens to get informed and get active in response. Visitors to pollworkersfordemocracy.org can pledge to work the polls, look up local officials information, and learn how to apply for pollworker positions. They are further supported with online materials and weekly teleconference calls offering pollworking resources and advice.


“For the first time in a national election this year, new, computerized equipment will be used in most polling places across the country.” said Joan Krawitz, Executive Director of VoteTrust USA, “Our goal is to bring citizens into the process to work the polls and to help both new and experienced pollworkers ensure that the November election runs as smoothly as possible for the voters at their polling places.”
The Pollworkers for Democracy campaign plans to collect pollworker observations through an online survey. Participants are encouraged to keep an eye out for problems at the polls such as the mishandling of voter registration requirements, delays and errors due to failing electronic voting systems, voter intimidation, and issues surrounding the use and counting of provisional ballots. The campaign will also be looking for reports of well-run precincts and best practices among elections officials. The pollworker survey is linked to a national Election Incident Reporting System supporting informed election reform solutions.


The media’s fake “balance” could have lethal consequences, since it has a lot of people thinking that (a) there’s lots of blame “on both sides” for 9/11, and, therefore, that (b) Bush/Cheney was not–at best–criminally negligent in failing to do anything at all to halt or even mitigate the terrorist attacks. So the received opinion is that Bush/Cheney’s busily “protecting” us right now, or that they could be doing a better job at it. In fact, there’s not a shred of evidence that they have any interest in protecting us: on the contrary.
Let’s assume they had no hand in those atrocities. Even in that case, the regime blew it so badly prior to 9/11 that they should all have been impeached, at least, four years ago. And here they are exploiting 9/11 as a symbol of their strength and prudence.

They get away with it because of “balance.” Too bad so few Democrats (right now I’m having trouble thinking of a single one) spoke up back at the time, to make the glaring point that BushCo, Giuliani and the rest of them made the catastrophe all that much worse by what they did or didn’t do before it struck.
Well, better late than never: Bob Kerrey and Bill Clinton both have found their voices. Here’s hoping that they keep it up, and that a lot of others join them.

FULL TRANSCRIPT: Clinton Takes On Fox News
Today, President Bill Clinton taped an interview with Fox News’ Chris Wallace, which is scheduled to be aired Sunday. He was told the interview would focus on his nonpartisan efforts to raise over $7 billion to combat the world’s biggest problems.
Early in the interview, Wallace attempted to smear Clinton with the same kind of misinformation contained in ABC’s Path to 9/11. Clinton was having none of it.
ThinkProgress has obtained a transcript of the interview. Here are some highlights -
Wallace repeats Path to 9/11 misinformation, Clinton fights back:

WALLACE: When we announced that you were going to be on Fox News Sunday, I got a lot of email from viewers, and I got to say I was surprised most of them wanted me to ask you this question. Why didn’t you do more to put Bin Laden and al Qaeda out of business when you were President? There’s a new book out which I suspect you’ve read called the Looming Tower. And it talks about how the fact that when you pulled troops out of Somalia in 1993, Bin Laden said “I have seen the frailty and the weakness and the cowardice of US troops.” Then there was the bombing of the embassies in Africa and the attack on the USS Cole.

CLINTON: OK..

WALLACE: …may I just finish the question sir. And after the attack, the book says, Bin Laden separated his leaders because he expected an attack and there was no response. I understand that hindsight is 20/20.

CLINTON: No let’s talk about…

WALLACE: …but the question is why didn’t you do more, connect the dots and put them out of business?

CLINTON: OK, let’s talk about it. I will answer all of those things on the merits but I want to talk about the context of which this arises. I’m being asked this on the FOX network… ABC just had a right wing conservative on the Path to 9/11 falsely claim that it was based on the 9/11 Commission report with three things asserted against me that are directly contradicted by the 9/11 Commission report. I think it’s very interesting that all the conservative Republicans who now say that I didn’t do enough, claimed that I was obsessed with Bin Laden. All of President Bush’s neocons claimed that I was too obsessed with finding Bin Laden when they didn’t have a single meeting about Bin Laden for the nine months after I left office. All the right wingers who now say that I didn’t do enough said that I did too much. Same people.

That is precisely the message Governor Ehrlich is trying to spread in Maryland. They are trying desperately to lower the number of voters at the polls on Election Day, so they can get the GOP to the polls and try to make the election theirs without having to go through the “formality” of counting absentee ballots, which they will find some way to disallow because they would presumably be overwhelmingly Democratic votes.

Colo. Judge Grudgingly Approves Machine Vote

DENVER, Sept. 22 — A judge on Friday chastised state officials for botching efforts to ensure that electronic voting machines are tamper-proof, but he cleared them for use in the November election, saying it is too late now to change course.

Denver County District Judge Lawrence A. Manzanares said the secretary of state’s office had violated state law by failing to come up with minimum security standards for the machines. He added that the office had done an “abysmal” job documenting which tests were performed on the machines and should not have allowed computer manufacturers to vouch for the security of their own products.

The judge said, however, that he would not bar the machines with the election just six weeks away and county clerks warning that they might not have time to print enough paper ballots.
Many of the machines will be used in Colorado’s most populous counties during the general election Nov. 7. A lawsuit filed by 13 voters claimed the machines were not secure, suggesting the accuracy of election results could be in jeopardy.

The following comes from RFK, Jr.’s latest article in
Rolling Stone, which I sent out the other day. I reproduce
it here because it finally proves that Bush & Co. robbed
Max Cleland of his Senate seat in 2002-just as many of
us have been arguing for the last four years, on the basis
of the ample evidence already out there (and a little bit
of common sense).

How did the US press explain the GOP’s surprising victory
in that race? Chambliss won, the pundits said, because
Chambliss’s attack ads did the trick. Those ads had cast
Max Cleland as a traitor, because the Senator opposed
the creation of the Department of Homeland Security.
The charge was not only outrageous and absurd-Cleland
lost three limbs in Vietnam-but utterly irrelevant, as
Cleland was quite popular in Georgia, and had been set
to win, according to the polls. But when he “lost” despite
all that, the press accepted it, and quickly found themselves
a handy (if preposterous) explanation for it. This also
despite the fact that Diebold had lately taken over Georgia’s
voting system.

Will the press now look back at that race and see that it
was scandalous? Probably not, unless we put it to them
loud and clear until they do.

Another question: Will Max Cleland now, at last, address
the crucial issue of his inexplicable “defeat”? So far he
has refused to say a single word about it, although
several of us has implored him to speak out. Maybe now
he’ll finally speak out as the patriot he really is.

Then, one muggy day in mid-August, Hood was surprised to see the president of Diebold’s election unit, Bob Urosevich, arrive in Georgia from his headquarters in Texas. With the primaries looming, Urosevich was personally distributing a “patch,” a little piece of software designed to correct glitches in the computer program. “We were told that it was intended to fix the clock in the system, which it didn’t do,” Hood says. “The curious thing is the very swift, covert way this was done.”

Georgia law mandates that any change made in voting machines be certified by the state. But thanks to Cox’s agreement with Diebold, the company was essentially allowed to certify itself. “It was an unauthorized patch, and they were trying to keep it secret from the state,” Hood told me. “We were told not to talk to county personnel about it. I received instructions directly from Urosevich. It was very unusual that a president of the company would give an order like that and be involved at that level.”
According to Hood, Diebold employees altered software in some 5,000 machines in DeKalb and Fulton counties – the state’s largest Democratic strongholds. To avoid detection, Hood and others on his team entered warehouses early in the morning. “We went in at 7:30 a.m. and were out by 11,” Hood says. “There was a universal key to unlock the machines, and it’s easy to get access. The machines in the warehouses were unlocked. We had control of everything. The state gave us the keys to the castle, so to speak, and they stayed out of our way.” Hood personally patched fifty-six machines and witnessed the patch being applied to more than 1,200 others.

The patch comes on a memory card that is inserted into a machine. Eventually, all the memory cards end up on a server that tabulates the votes – where the patch can be programmed to alter the outcome of an election. “There could be a hidden program on a memory card that adjusts everything to the preferred election results,” Hood says. “Your program says, ‘I want my candidate to stay ahead by three or four percent or whatever.’ Those programs can include a built-in delete that erases itself after it’s done.”
It is impossible to know whether the machines were rigged to alter the election in Georgia: Diebold’s machines provided no paper trail, making a recount impossible. But the tally in Georgia that November surprised even the most seasoned political observers. Six days before the vote, polls showed Sen. Max Cleland, a decorated war veteran and Democratic incumbent, leading his Republican opponent Saxby Chambliss – darling of the Christian Coalition – by five percentage points. In the governor’s race, Democrat Roy Barnes was running a decisive eleven points ahead of Republican Sonny Perdue. But on Election Day, Chambliss won with fifty-three percent of the vote, and Perdue won with fifty-one percent.
Diebold insists that the patch was installed “with the approval and oversight of the state.” But after the election, the Georgia secretary of state’s office submitted a “punch list” to Bob Urosevich of “issues and concerns related to the statewide voting system that we would like Diebold to address.” One of the items referenced was” Application/Implication of ’0808′ Patch.” The state was seeking confirmation that the patch did not require that the system “be recertified at national and state level” as well as “verifiable analysis of overall impact of patch to the voting system.” In a separate letter, Secretary Cox asked Urosevich about Diebold’s use of substitute memory cards and defective equipment as well as widespread problems that caused machines to freeze up and improperly record votes. The state threatened to delay further payments to Diebold until “these punch list items will be corrected and completed.”

Diebold’s response has not been made public – but its machines remain in place for Georgia’s election this fall. Hood says it was “common knowledge” within the company that Diebold also illegally installed uncertified software in machines used in the 2004 presidential primaries – a charge the company denies. Disturbed to see the promise of electronic machines subverted by private companies, Hood left the election consulting business and became a whistle-blower. “What I saw,” he says, “was basically a corporate takeover of our voting system.”

Bush’s ‘Dirty War’ Amnesty Law

The United States is following the lead of “dirty war” nations, such as Argentina and Chile, in enacting what amounts to an amnesty law protecting U.S. government operatives, apparently up to and including President George W. Bush, who have committed or are responsible for human rights crimes.
While the focus of the current congressional debate has been on Bush’s demands to redefine torture and to reinterpret the Geneva Conventions, the compromise legislation also would block prosecutions for violations already committed during the five-year-old “war on terror.”
The compromise legislation bars criminal or civil legal action over past violations of Common Article 3 of the Geneva Conventions, according to press reports. Common Article 3 outlaws “violence to life and person,” such as death and mutilation as well as cruel treatment and “outrages upon personal dignity.”
The legislation now before Congress also would prohibit detainees from citing the Geneva Conventions as a legal basis for challenging their imprisonment or for seeking civil damages for their mistreatment. [Washington Post, Sept. 22, 2006]

Rebels? Mavericks? Assholes, More Like

This is a quick venting-vehicle diary. I simply need to get this out, and see if you’re with me. And I can’t help but think that you are.

Here’s some copy that renders (if you know what I mean) the words “rebel” and “maverick”:

The Los Angeles Times: “The Bush administration reached agreement with three rebellious Republican senators today over a formula for terrorist trials, possibly paving the way for proceedings against some of the most notorious terrorist suspects in U.S. custody”; “Sen. John McCain of Arizona, a former Vietnam prisoner of war who was one of the mavericks…”

The BBC: “Rebel Republicans had demanded a provision making it clear that torture of suspects would be barred.”

IV. A CALL-TO-ARMS

Yesterday, President Bush and several members of the Senate struck a deal on human rights. In the process, they dealt away America’s commitment to fundamental human rights principles.

Make no mistake about it, this deal is a betrayal of the America we believe in. No human rights activist can remain on the sidelines in the days ahead. Call on your Senator to oppose these dangerous provisions. We are literally days away from action in Congress on a proposal to:
  • Abandon the rule of law and give the President the freedom to interpret the Geneva Conventions any way he sees fit.
  • Provide immunity to those responsible for past human rights abuses.
  • Exempt from prosecution those who authorize treatment traditionally considered torture.
  • Strip detainees of access to US courts.
The soul of our nation is in jeopardy. Everything we believe in is on the line. That’s why we’re mobilizing the entire Amnesty community. We’re going into action today and we won’t stop until every last Senator has made it clear whether he or she is willing to stand up for the America we believe in.

Please act today. Those behind this dangerous deal are doing everything they can to quickly build momentum. We have to break that momentum and we have to do it now.

American soldiers will be placed in greater threat of torture and cruel treatment when captured, not just by one or two rogue nations, but by many nations that follow America’s lead.
