We need to flood Senator Lieberman and Senator Dodd’s offices and speak out against the confirmation of Samuel Alito to the U.S. Supreme Court on Monday, Jan. 30th. At 4:30 on Monday there will be a vote for cloture which will be a vote to end the debate. We need to have our senators support the call by Senators Kerry and Kennedy to stand up against this confirmation.
Senator Dodd has stated that he is willing to end the debate.
Senator Lieberman has not stated his position on a filibuster.

The NY Times editorial agrees with all the civil rights organizations, women’s, labor and environmental groups, that this is the time to show courage and use the filibuster. (See below)

At 4:30 PM on Monday, Jan 30, the Senate will vote on how to proceed – the cloture vote. We need 41 votes for a filibuster instead of an up or down vote on Alito.

Sheila, Contuing to expect more miracles

Senator Kennedy just had a conference call with a number of bloggers to update us on his and Senator Kerry’s filibuster effort, and to encourage the netroots and the grassroots to keep up our efforts. He’s very excited by what he’s seeing here and throughout the blogosphere, and gave a great pep talk.

He is encouraging you to contact your Democratic Senators, regardless of what they might have said so far, but specifically mentioned Senators Pryor, Lincoln, Cantwell, Murray, Baucus, Harkin, Levin, Bayh, Lautenberg, Menendez, and Lieberman. In addition, he said to keep the pressure on Republican Senators Snowe, Collins, Chaffee, and Stevens.

Senator Kennedy talked in particular about one thing that I think is critical to keep in mind as we approach our Senators, and for them to keep in mind as they are considering this vote. We need to overcome the media noise machine by letting our Senators know that in voting their conscience, and making it clear that they are voting on principle, on conscience, they will overcome the media noise machine calling them obstructionists. We can help them realize this by letting them know that we’ve got their backs. That they are voting our conscience as well, and that we will not forget their courage.

Here are some more thoughts on breaking down the Republican talking points we know will be flooding the traditional media from Ed Kilgore:

I can only hope Senate Dems make a serious effort to stay focused on the Big Case against Alito during the debate…. It’s especially important that they deal with the GOP “obstructionist” talking point by relentlessly reminding people that Bush deliberately picked this fight by giving conservative activists their very own Supreme Court nominee. And it wouldn’t hurt to spend some time exposing the hypocrisy of “pro-choice” Republican Senators who are deliberately giving the anti-abortion movement the fourth vote they need–just one short of a majority–to erode and then overturn Roe v. Wade.

This is, as Senator Kennedy reminded us, a generational battle. Samuel Alito on the Supreme Court could turn back a generation’s worth of progress in civil rights, in worker protections, in equality for women, in environmental protection, in the fight of the little guy against the corporation. And Samuel Alito on the Supreme Court will affect the generations to come. We cannot afford to refight the battles of the past 40 years during the next 40 years.

This is an uphill battle, but one in which we can at the very least achieve a moral victory. Approached with principle, with passion, and with vigor, a moral victory is not a hollow victory. As Senator Kennedy told us, “You don’t ever lose fighting for principle, for what is decent and right. You don’t ever lose when you have the power, the force of being correct.”

Hello Mr. Miller,

I am writing to you now because Pittsburgh (Allegheny County) is on the brink of purchasing Diebold voting machines!!! I am currently reading “Fooled Again” and took your book to the County meeting yesterday, along with several other publications, to try and stop our county from making this horrendous mistake. We are currently looking for any kind of help in our 72 hr. effort to protect the vote in Pittsburgh. I am going to paste a letter I just wrote to Thom Hartmann, whose show I listen to daily, to give you an idea of what’s going on. I also just sent a copy of this letter to Bob Fitrakis. I’m desperately trying to do what I can to keep Diebold from weasling in and taking over my vote!!!

Any assistance you can offer at all would be most appreciated.

What a week…first the Alito effort, now this…..

We’ve got a bit of an emergency here in Pittsburgh……I got a call late Thursday afternoon from our County Council Pres., a Democrat, and friend of mine. He tipped me off that the Election Board of Allegheny County was holding a meeting ‘open to the public’ at 8am the next morning (yesterday). He then added in his message, oh, by the way, Diebold has made it onto the short list, and looks like they’re the favorite now!

Well, I went into high gear and called on several PA voting advocates I had just heard about the night before at my Dem. Party Mtg. (http://www.votepa.us) I got emails out to these activists, and we managed to get several people to show up at the meeting the next morning. Several of us made presentations. I even provided the councilmen with articles, talking about the problems with Diebold, and electronic voting in general. Thank goodness we were there, because the county was prepared to go ahead and sign a contract with Diebold!!! We managed to convince them to take some time to further research their options….

Here’s what I’m wondering. I haven’t spoken with her yet – but I’m sure she’d be willing to do this – would you consider having Mary Beth Kuznik (http://www.votepa.us/speakers.html) on your show Monday, or even anytime you could get her on (this might help other counties in the same predicament)? She is extremely knowledgeable about the various machines available, is meeting with secretary of state and other officials constantly, and is very articulate. I also think Dr. Richard King (a psychologist) who is working alongside Mary Beth, would also make an excellent guest.

This is not just about Pittsburgh and Allegheny County. Hundreds of counties across the US are scrambling to purchase new voting machines to comply with the 2002 HAVA Act. The problem is, the feds have offered money – in Allegheny County, 12 million, but only if counties purchase machines by a certain date. The original fed. deadline was 12/31/05. No one seems sure how long this money will be available. The other complicating factor is, that in PA, as in many other states, legislation has been proposed to require a paper verifiable trail, but the house and state bill have been tabled by state republicans and still sits in committee – another issue which needs media attention….

Mary Beth mentioned yesterday that several other states – all of NY, half of PA, much of CA, are in voting machine chaos. Here’s another thing you might want to read that I dug up yesterday….a citizen is trying to amend the 2002 HAVA act!!! http://www.wordsunltd.com/

Meanwhile, time is of the essence here in Pittsburgh. I am trying this weekend to help Mary Beth and Richard (who is out of town w/ family) find a lawyer to help us rewrite a lawsuit and injunction that they just used in nearby Westmoreland County, by this Tuesday, in case it’s our last chance to stop Pittsburgh from purchasing Diebold. I’ll attach those as well. The suddenness of this move to enter into this contract with Diebold in Allegheny caught all of us off guard…so we’re scrambling….

If we can get Mary Beth on your show Monday, it will help generate more publicity about Tuesday’s meeting in Pittsburgh. It will also help raise awareness (as someone in the chat remarked yesterday), that folks better look into what their county is doing in terms of buying new voting machines! (I’m still not sure why our county Election Div. was apparently trying to ‘sneak’ this meeting in….the 3 individuals who will make the decision, our CEO Dan Onorato, and 2 councilmen, one Dem. one Repub., are all in favor of paper, and do seem like they’re trying to do the right thing, but feel like they’re in a bind to purchase something soon. I’m not sure where the ‘push’ is coming from…..not sure if the fix is on w/ Diebold and the county workers who pulled together the bids or what. Oh, there was a Diebold ‘suit’ sitting in the audience yesterday….didn’t say a word. Very creepy.)

Sorry this is so long. This is a complicated issue, but it’s critical, and it’s happening now, and I thought you’d want to know about it.

I don’t know whether their fax machines are filled or not and I don’t have a fax. If someone could test the waters on that and get back to Mark, that would be very good.

I am ambivalent about making a list of which senators to concentrate on, because what if we pick the wrong senators. And I like the idea of people following their own hearts, minds, intuition about who to call. On the other hand, people have information sometimes about who to focus on and what is happening right then that we all need to hear.That being said, my own short list so far are Biden, – (tell him he will never be president if he does not filibuster;not clear yet whether he is undecided about filibuster or is against) and Inouye (only democratic in gang of 14 to vote against Roberts and will vote against Alito)

I am wondering if we can get it together by Sunday at say about 5PM to have vigils/standouts all over the country demanding a filibuster and am talking with others about this.

I know there are many reasons why Alito does not belong on the Supreme Court, but a very visible symbol would be for each one of us to carry a hanger – the symbol of women dying in back alley abortions, often done with coat hangers, when abortions were illegal.

WE CAN STOP ALITO THIS WEEKEND
The last two days have been amazing.
Early Thursday afternoon, we broke the news that Senator John Kerry would lead a filibuster against Judge Sam Alito if he could get 41 Senators to sustain the filibuster. Three hours later, CNN confirmed our story.
Naturally, the White House freaked out and told Senator Bill Frist to schedule a cloture vote as quickly as possible – Monday at 4:30 p.m. – to prevent Democrats from uniting behind Kerry.
But even as Karl Rove was doing his dirty work, progressive activists like you were calling your Senators urging them to support John Kerry’s filibuster.
And one by one, Democratic Senators began to turn around.
At the start of the day, only Dick Durbin and Debbie Stabenow supported Kerry and Kennedy. Just before noon, Hillary Clinton’s office called to say she supported us. Then Harry Reid came on board, along with Barbara Boxer, Russ Feingold, Ron Wyden, Chris Dodd, and (I think) Chuck Schumer.
Most importantly, we even picked up Dianne Feinstein, who just yesterday said she opposed a filibuster.
That’s 12 votes for a filibuster – and exactly 12 more votes than we had two days ago!
I believe we really can stop Alito by Monday at 4:30 p.m. – but here’s what we must do.
1. Ignore the media whores. Karl Rove is feeding them lies as he always does, and they are swallowing those lies as they always do. The only media that matters is the media we are creating right here by calling each Senator and getting a YES or NO statement from them.
3. Keep calling the Senators who are undecided or opposed to a filibuster. You can call their DC office all weekend and leave polite but firm voicemails urging the Senators to support Kerry’s filibuster. When offices open on Monday 9 a.m. ET, make another round of calls. Let’s shut down the Capitol switchboard on Monday!
4. Call the DNC (202-863-8000) and the DSCC (202-224-2447) and tell them your 2006 contributions will depend on the success of the Alito filibuster. Tell them they need to get every Democratic Senator on board.

5. Call talk shows like Air America, C-SPAN, etc. and talk about what we’re doing on this blog and how we’re killing ourselves to stop Alito – and how we can win if everyone who cares about the future of our Democracy joins us.
6. Keep hope alive – because American Democracy is worth it!!!
